2) Definitions
- “User” means anyone using Hawky (customers, vendors, delivery partners).
- “Vendor” means a street vendor/hawker/food business listing on Hawky.
- “Customer” means a buyer placing orders on Hawky.
Hawky operates a marketplace/intermediary platform connecting Customers and independent Vendors.
3) Eligibility & Account
You must be 18+. Provide accurate information and keep your account/OTP confidential. Notify us immediately of any unauthorised use.
4) Our Services (Marketplace Role)
We facilitate discovery, ordering, and (where applicable) delivery coordination. We do not own or control Vendor businesses or prepare food; each Vendor is responsible for its products, compliance, and service. We display required seller details and provide complaint-tracking.
5) Vendor Responsibilities
- Maintain valid FSSAI licence/registration and comply with food-safety laws.
- List accurate menus, prices (incl. taxes/fees), allergens, and availability; honour accepted orders.
- Comply with local licences/permissions and Legal Metrology laws.
- Prepare/pack hygienically and lawfully deliver (directly or via partners).
- Provide returns/refunds per law and stated policy; no deceptive practices or misuse of customer data.
6) Ordering, Pricing, Fees & Taxes
Prices are set by Vendors. Hawky may charge a platform and/or delivery fee (shown at checkout). Applicable taxes are displayed. Order breakdowns are shown before payment; consent is taken via explicit user action.
7) Payments
Online payments are processed by third-party gateways; we don’t store card/UPI credentials. Cash on Delivery (if available) may have eligibility limits.
8) Delivery & Tracking
ETAs are estimates. For routing/safety, delivery partners may share live location during active trips. If delivery isn’t possible, we may cancel and refund applicable amounts.
9) Cancellations & Refunds
- Customer cancellations: As per the Vendor’s policy.
- Vendor issues: We facilitate refunds/adjustments as per policy and law.
- Refunds are processed per payment-provider timelines with complaint-tracking IDs.
- No hidden cancellation fees; charges must be disclosed.
10) User Content & Acceptable Use
Do not break the law, infringe IP, post obscene/defamatory content, attempt fraud, or interfere with the platform. Violations may result in suspension/termination.
11) Intellectual Property
All app/website code, logos, and UX are Hawky’s IP or licensed. Vendors grant Hawky a non-exclusive, worldwide licence to display and promote their brand, menus, and photos on Hawky and affiliated channels.
12) Privacy
Use of Hawky is governed by our Privacy Policy.
13) Disclaimers & Limitation of Liability
Hawky provides the platform “as is.” Vendors are solely responsible for food quality and safety. Our aggregate liability is capped at ₹10,000 or the fees you paid to Hawky in the last 3 months, whichever is higher.
14) Suspension & Termination
We may suspend/terminate access for violations, fraud risk, unlawful activity, or non-payment. Vendors must fulfil accepted orders even after delisting, where required.
15) Changes to Terms
We may update these Terms. Continued use means you accept the changes. Material changes will be notified in-app/email.
16) Governing Law & Dispute Resolution
Indian law governs. Courts/consumer commissions in Bengaluru (Karnataka) have jurisdiction. Consumers may approach consumer dispute redressal commissions. Arbitration is optional, available only if the consumer chooses it after a dispute arises.

Hawky is a marketplace/intermediary that connects customers with independent food vendors. Hawky does not prepare or manufacture food. Vendors are solely responsible for food quality, hygiene, safety, ingredients, and allergen disclosures. If you face any product or health-related issue, contact us with your Order ID and details; we will facilitate resolution/refund under the posted policy and applicable law.
